IATA offers a comprehensive suite of print publications on a multitude of subjects. The following set forth the shipping terms and conditions applicable to the purchase of any print publications via the IATA Online Store.
1.0 Introduction
IATA offers the air transport industry a comprehensive suite of print publications on a multitude of subjects. More than 300 titles are available for purchase on the International Air Transport Association’s (IATA) Online Store, covering all aspects of aviation.
The following set forth the shipping terms and conditions applicable to the purchase of any print publications via the IATA Online Store.
In the event of a conflict between these terms and the terms and conditions on any IATA air waybill or other transit documentation, these terms and conditions will govern and apply.
2.0 Definitions
As used herein, the following terms are defined as follows:
"Air waybill" means any shipping document, manifest, label, electronic entry or similar item.
"Embargo" means a refusal by IATA, for a limited time, to ship over any route or segment thereof to any area or point in the world.
"Recipient" or "consignee" means the entity which is financially responsible (i.e. the buyer) for the receipt of a shipment and whose name is listed on the air waybill.
"Shipment" means all package(s) shipped by us on a single air waybill.
"Transportation charges" means solely amounts assessed for shipment movement, and does not include any other fees or charges.
"You" and "your" refer to the recipient/consignee, its employees, principals, and agents.
"We," "our," "us," "seller," and "IATA" refer to the International Air Transport Association, its principals, subsidiaries, branches and affiliates, and their respective employees, contractors, and agents.
3.0 Return and Refund Policy
Please refer to the IATA Return Policy applicable to all sales of print publications purchased on the IATA Online Store.
4.0 Damaged Item(s)
All orders must be inspected promptly upon delivery and claims for item(s) that arrived damaged must be filed no later than five (5) business days after the delivery date.
Claims for damaged items must be submitted via the IATA Customer Portal. Please include your company name, order number, publication title(s) and quantities. Please also attach clear photos showing the following:
- Outside of the package (box), including photos of the top and bottom of the box and any areas where tape and labels were applied.
- All areas of the damaged box.
- Inside of the box in the condition when it was opened.
- Packing material used (e.g. bubble wrap, paper, etc.).
All areas of damage to the item(s). If multiple copies of the same item(s) were damaged, please provide a single photo per item with all affected copies clearly visible.
Please Note: damaged shrink wrapping alone does not constitute damage to the publication and will not be considered eligible for a replacement or refund.
5.0 Missing Item(s)
All orders must be inspected promptly upon delivery and claims for, missing item(s) must be filed no later than ten (10) business days after the delivery date.
Claims for missing item(s) must be submitted via the IATA Customer Portal. Please include your company name, order number, publication title(s) and quantities. Please also attach clear photos of the following:
- Outside of the package (box), including photos of the top and bottom of the box as well as any areas where tape and labels were applied.
- Inside of the box in the condition when it was opened.
- All item(s) received.
6.0 Shipping Delays
Publications in stock are delivered three (3) to fifteen (15) business days from the date the order is received. Carriers will attempt to deliver the shipment up to three (3) times. After three (3) failed attempts, the package will be returned to IATA.
Shipments may be delayed for a variety of reasons, including, but not limited to:
- Customs – Shipments may be inspected by Customs authorities which can lead to delays in the delivery time. Delays can also occur when the necessary documents are filled out incorrectly or are missing.
- Missing or incorrect information/documents – if certain information/documents required from the consignee by local governments is missing and/or incorrect, this may cause delays in delivery. All the necessary information/documents must be completed correctly and provided promptly, including the following:
- Import license and or local broker
- Tax ID number
- Proof of payment
- Consignee forms: KYC, IEC, PA
- Custom value declaration form
- Certificate of origin
- Non-payment of fees – Additional ancillary fees and/or service charges may apply as required by applicable government regulations and must be paid by the consignee. There may also be other applicable local fees, such as processing fees and storage fees. Storage fees will be applicable if the consignee is not available for the customs clearance process. The consignee will be responsible for any additional charges or fees imposed by customs officials. Non-payment of these fees may delay in delivery and eventual cancelation of delivery.
- Package redirection – If you decide to change the delivery address after the delivery service has been confirmed and the information has been entered into the courier company's system, the redirection may lead to delayed delivery. Even if the new address is proximate to the one initially provided, the information still has to be reprocessed by the courier company's system, potentially causing delays.
- Difficulty accessing the premises – The courier may need an access code to enter a building.
- Undeliverable shipments – A shipment will be marked as undeliverable after three (3) delivery attempts by the carrier.
- Weather conditions – Bad weather can slow or prevent transit and cause delayed delivery.
- Unforeseen circumstances – Unforeseen events or factors beyond the carrier's control can affect the delivery time and cause delays.
7.0 International Commercial Terms (Incoterms)
International Commercial Terms (Incoterms) are a series of predefined commercial terms published by the International Chamber of Commerce (ICC) relating to international business law. Incoterms are represented by three-letter trade terms related to standard contractual sales practices. The rules are intended primarily to communicate the tasks, costs, and risks associated with the international transportation and delivery of goods. "Incoterms" is a registered trademark of the ICC.
The Incoterms applicable to shipments of publications purchased from the IATA Online Store include:
- Delivered Duty Paid (DDP): Under DDP, the seller is responsible for arranging carriage and delivering the goods at the named destination. The shipment is cleared for import and all applicable taxes and duties paid (e.g., VAT, GST). The seller is responsible for import customs clearance and payment of any applicable taxes and/or import duties.
- Delivered at Place (DAP): Under DAP, the seller is responsible for arranging carriage and delivering the goods, ready for unloading from the arriving conveyance, at the named destination. The buyer is responsible for import customs clearance and any applicable local taxes or import duties.
8.0 Shipping Restrictions
IATA reserves the right to restrict our service areas and delivery commitments anywhere in the world for our various publications. As amended solely by us from time to time without notice, these restrictions are incorporated into these terms and conditions and include, without limitation:
- Embargoed countries: No deliveries will be made to countries under embargo.
- P.O boxes: No courier company will deliver packages to a P.O. box without a valid telephone number.
9.0 Force Majeure
Neither the seller nor the consignee shall be liable for any failure or delay in performance of its obligations under, or in relation to, these terms and conditions or the shipment/delivery of any publications, arising out of, or caused, directly or indirectly, by circumstances beyond its reasonable control, including, but not limited to, acts of God, earthquakes, fires, floods, wars, civil or military disturbances, acts of terrorism, sabotage, strikes, pandemics, epidemics, quarantines, travel restrictions, riots, power failures, computer failures, or any other such circumstances. In the event of a failure or delay, both parties shall use commercially reasonable efforts to improve the effects of any such failure or delay.
10. Other Terms
These terms and conditions constitute the entire agreement governing your shipment.
Any failure to assert any rights that we or you may have under these terms does not constitute a waiver of our rights to assert the same or any other right at any other time or against any other person or entity.
If any provision of these terms is found to be invalid or unenforceable, then the invalid or unenforceable provision will be stricken from these terms without affecting the validity or enforceability of any other provision.
These terms and conditions shall be governed by the laws of the Province of Quebec, Canada, and the laws of Canada applicable therein, as if they were a contract wholly entered into and wholly performed within the Province of Quebec, without reference to choice of law provisions. You irrevocably agree to submit to personal jurisdiction and venue of the courts sitting in Montreal, Quebec, Canada.
